According to the Social Security Code II (ALG II), students whose education can be funded on the merits of BAföG have no entitlement to support to defray their living costs.
The entitlement to unemployment benefit II for people receiving support for their studies through BaFöG occurs only if the studies are interrupted due to illness, pregnancy or child rearing (academic leave).

If there is a particular hardship, the ALG II may be exceptionally granted in the form of a loan. However, the requirements are stringent.
The exclusion of benefit does not include the claim for benefits in special circumstances. For example, in case of the need for aid, an additional allowance can be requested from the 13 week of pregnancy or for single parents, etc.
Benefits for family members, especially for children living with the applicant, are also not affected. As a consequence, the ALG II/social welfare benefit can be requested for them if their maintenance is not ensured otherwise.
Students receiving support for their studies through BaFöG are usually capable of working and can only receive unemployment benefit II, if any at all. Social welfare benefits and social welfare assistance can only be claimed on when disability occurs.
