Students are entitled to housing benefits if they have no right to an education grant.

This applies:

  • if the maximum funding duration has been exceeded

  • if the necessary proof of achievement was not provided

  • if the field of studies was changed without good cause

However, if the student is entitled to no education grant because his/her parents’ income is too high, s/he has no right to housing benefit.

Also, students funded through BAföG can receive housing benefits if they live in community with the spouse and/or child/children, those who basically are not entitled to BAföG.
An important prerequisite for the receipt of a housing benefit is that students demonstrate their own housekeeping management. Students living with their parents get no housing benefit. Exception: The parents of the students are entitled to housing benefit; in this case include all individuals living in the household, including the students.
Housing benefits can only be obtained from the month in which the application was submitted and, of course, will be paid retroactively by the competent office in case of delayed processing.

Overall, students’ entitlement to housing benefits is a complicated subject. A personal conversation at the General Social Counselling office and/or free consultation at the Legal Counselling office is recommended in each individual case.
